CONTRACTUAL OBLIGATIONS
1) All Domain Names are registered
on behalf of our clients by 'DFW Advertise' for a period of 1
(One) year for .com, .net, .us, .org names and for 2 (two) years
for .co.in, .biz, .info names depending upon the availability
of the choice of Domain Name along with compulsory hosting of
website..
2) Server
space is booked and registered by 'DFW Advertise' according to
the quantity mentioned explicitely in the 'webdesigning order
form/webhosting order form' and according to the specified nature
of the server mentioned i.e. Linux or NT as mentioned in the packages
for a term of one year only.
3) All
Agreement Contracts are valid for a period of 1 (One) year only,
during which period 'DFW Advertise' will be responsible for the
initial booking of Domain Name for its clients(subject to availability),
booking of server space according to the volume mentioned in each
package as MB (mega bytes), for the specified server type mentioned
as 'Linux Server or NT Server'. 'DFW Advertise' will host/upload
the site with the materials/contents supplied by our clients and
maintain the same for 1 (one) year only in case of a web designing
package. 'DFW Advertise' will NOT upload contents of any site
for any customer opting for a web hosting package. 'DFW Advertise'
in case of web hosting packages will supply all passwords and
relevant details to its customers to host/upload site contents
and use/create POP email accounts. In case of web designing packages
'DFW Advertise' will only give passwords to use/create POP email
accounts but not FTP passwords.
4)'DFW
Advertise' is/will not be responsible for the nature and the contents
of the websites it hosts for its clients. All data/materials are
supplied by its clients for hosting and 'DFW Advertise' is not
responsible for authenticty/legality of such contents.
5) 'DFW
Advertise' will not be responsible for any legal consequences
arising out of the nature/contents of any site it build for its
clients. Clients are requested to see for themselves that no part
of the contents they send to 'DFW Advertise' for publication on
their site violates any law in any way.
6) .com,
org, .net, .us Domain Names and All Space Booked of our clients
are valid for 1 (one) year only, for .biz and .info names the
validity is 2 (two) years, if any client does not renew the contract
before the completion of the term of the Agreement, 'DFW Advertise'
will not be held responsible if someone else books the same domain
name from another registrar upon completion of the said periods
from the date of signing of the 'service contract Agreement'.
7) For
web designing packages, Passwords for Domain Name and FTP uploads
and control panels will not be given out to customers without
a written application explicitely mentioning the request for the
same. In case of a client being handed over passwords mentioned
above, 'DFW Advertise' will not take the responsibilties of safe-keeping
of all passwords, client's site-security and its maintanance.
8) All
payments will have to be made in advance i.e. upon signing of
the 'service contract agreement' in cash / Check / c/c / Money
Order made payable to: "DFW Advertise", payable at : Weatherford,
Texas, in case of face-to-face/office dealings. For online orders,
payments have to be cleared within 10 working days of ordering,
by Paid orders only paid to: DFW Advertise payable at Weatherford,
Texas, failing which such orders will stand null and void. For
online orders, payments recieved beyond 10 days, email request
will be sent to the person/organization placing the order to re-order
online within 15 days failing which the amount will be forfeited.
9) All
Contracts will be executed after payments are cleared in full
by the client.
10)
For web designing packages Websites will be hosted within 15-25
days of recieving the full payment from the client or recieving
the data/contents/materials for hosting in full from the client
whichever is later, depending upon the package opted for. For
web hosting packages account activation will be done within 7
Days.
11)
Terms/Package of contracts once signed will not be reconsidered
nor any money returned to the client. All payments made are non-refundable

'DFW Advertise' is/will not be responsible for cases of hacking/breach
of security or any other illegal activities by any outsider causing
server break-downs or any subsequential loss of business to its
clients.
13)
'DFW Advertise' is/will not be responsible for server shut-downs
for technical glitches or routine maintanance during the course
of the Agreement and subsequent loss of business to its clients.
14)
'DFW Advertise' is/will be not responsible for any kind of transaction/actions
our clients make from thier sites or for whatever purposes they
use their web-site for. We are not responsible for legal, monetary
or other issues arsing out of such actions of our clients.
15)
Any kind of illegal/pornographic/racist/defamatory/insulting/obscene/blasphemous/objectionable
materials are not allowed on our servers. Any such materials found
will lead to termination of the service contract Agreement, complete
shut-down of the website, and initiation of legal proceedings
against any such client.
